Truckers’ Calif. Meal Break Action Preempted By Fed. Law

Law360, New York (February 14, 2012, 3:19 PM EST) -- A California federal judge last week tossed a putative class action against Performance Food Group Inc., saying the meal break claims of three ex-PFG truck drivers were preempted by federal law and setting the stage for an appeals court showdown.

U.S. District Judge Jacqueline Nguyen dismissed the drivers' case with prejudice on Feb. 8. She agreed with PFG's argument that their claims were trumped by Federal Aviation Administration Authorization Act, which was enacted in 1994 to preempt state trucking regulation and bars state laws related to...
