Consumer Cries Foul Over Gerber Probiotic Claims

Law360, New York (February 14, 2012, 12:24 PM EST) -- Gerber Products Co. was hit with a proposed nationwide class action in California on Friday, alleging the company claims that products containing probiotics boost babies' immune systems when, in fact, probiotics may harm them.

The suit, brought in federal court by Long Island, N.Y., resident Saba Siddiqi, names New Jersey-based Gerber and its parent company, California-based Nestle USA Inc., as defendants. It brings claims for violation of California's Consumers Legal Remedies Act and Unfair Competition Law, as well as the New Jersey Consumer Fraud Act....
