Monsanto Agent Orange Suits End In Medical Monitoring Deal

Law360, New York (February 24, 2012, 6:06 PM EST) -- A West Virginia judge on Friday awarded Monsanto Co. and class counsel Calwell Practice PLLC preliminary approval of their settlements incorporating a 30-year medical monitoring program for residents potentially affected by Agent Orange herbicide produced by a nearby, now-defunct plant.

Putnam Circuit Judge Derek Swope's approval will wrap up all pending litigation and related class actions in West Virginia over chemical exposure and related health issues allegedly caused by the Nitro, W.Va., plant's negligent disposal of dioxin waste. Neither Monsanto nor its predecessors that previously owned the plant, were held liable for any wrongdoing in the agreement.
