KeySpan Antitrust Suit Faces Dim Prospects In 2nd Circ.

Law360, New York (February 28, 2012, 6:13 PM EST) -- A Second Circuit panel on Tuesday expressed doubt that it will revive a consumer's putative class action that claimed KeySpan Corp. violated antitrust laws when it used a complicated financial transaction to corner the New York City electricity market.

The consumer's suit could be barred by a U.S. Supreme Court decision that says utilities, not their clients, are the only parties that can bring suits against suppliers who commit antitrust violations, the panel said at a hearing.
