Gristede’s CEO Says He's Not An 'Employer' Under FLSA

Law360, New York (February 29, 2012, 7:54 PM EST) -- The owner of Gristede’s Foods Inc., Manhattan’s largest supermarket chain, told the Second Circuit on Tuesday that he shouldn’t be held liable for part of a $3.5 million overtime class action settlement because he isn’t an employer under the Fair Labor Standards Act.
