Smokers Push 2nd Circ. To Resurrect Philip Morris Suit

Law360, New York (March 1, 2012, 10:08 PM EST) -- Smokers who want Philip Morris USA Inc. to provide them with lung cancer screening asked the Second Circuit on Thursday to reopen their class action against the tobacco company, saying it could have designed a safer cigarette.

Even though many smokers knew cigarettes were dangerous, Philip Morris should be ordered to pay for regular cancer screenings for its long-term customers since it could have designed cigarettes with far lower levels of tar and other carcinogens, the plaintiffs' attorney Victoria E.
