Reply Memo Turns Abbott Suit More Contentious

Law360 (August 3, 2007, 12:00 AM EDT) -- The plaintiffs in a class-action lawsuit against Abbott Laboratories Inc. have accused the pharmaceutical giant of introducing new evidence not produced during discovery as part of its efforts to dismiss the case.

In court documents filed Thursday with the U.S. District Court for the Northern District of Illinois, the plaintiffs, all employees of Abbott before the 2003 spin-off of its hospital products business into Hospira Inc., asked a judge to strike a section of Abbott's reply memorandum in support of its motion for summary judgment....
