Texas High Court Denies Denbury Eminent Domain For Pipeline

Law360, New York (March 2, 2012, 7:54 PM EST) -- The Texas Supreme Court on Friday reversed a lower court’s decision allowing Denbury Resources Inc. to use eminent domain for a carbon dioxide pipeline, ruling the company had not sufficiently shown a public use that would justify taking private property.
