Nordstrom's Arbitration Bid Rebuffed In Wage Action

Law360, New York (March 8, 2012, 8:42 PM EST) -- A California federal judge on Thursday rejected Nordstrom Inc.'s bid to compel arbitration in a putative class action alleging unpaid wages, holding that the purported imposition of an arbitration agreement after the suit was filed amounted to an improper class communication.

U.S. District Judge Jeffrey Miller shot down Nordstrom's attempt to force salespeople Gina Balasanyan and Nune Nalbandian to individually arbitrate their claims, but granted the company's motion to consolidate their case with another wage-and-hour suit suit filed by ex-Nordstrom workers before the same court....
