Plaintiffs Fight EDS’ Bid To Toss ERISA Suit

Law360, New York (August 7, 2007, 12:00 AM EDT) -- A group of plaintiffs that sued Electronic Data Systems Corp. has lashed out at the technology services company’s motion to dismiss certain ERISA claims, arguing that the move is "misdirected and hopelessly premature."

In a response to EDS’ motion to dismiss certain claims in the third amended complaint, the plaintiffs said Friday that the company’s bid was “merely an attempt to take a pre-emptive shot at class certification, not a legitimate motion to dismiss.”
