Azur, Avanir Push To Arbitrate $35M FazaClo Feud

Law360, Los Angeles (March 9, 2012, 5:40 PM EST) -- A doctor who claims Azur Pharma Ltd. and Avanir Pharmaceuticals Inc. breached contracts for the rights to antipsychotic drug FazaClo should be forced to arbitrate his demand for over $35 million, an attorney for Azur told a California judge Friday.

Azur’s lawyer Michael D. Kibler of Simpson Thacher & Bartlett LLP argued Friday that even though Dr. Neal R. Cutler hadn’t agreed to arbitration when he sold his company Alamo Pharmaceuticals LLC and its patented tablet to Avanir in 2006, his decision to sue for breach...
