Lockheed Can't Be Sued For US Contract Work, Fed. Circ. Rules

Law360, New York (March 14, 2012, 7:31 PM EDT) -- The Federal Circuit on Wednesday reversed a U.S. Court of Federal Claims decision that allowed Zoltek Corp.'s patent infringement claim against Lockheed Martin Corp., ruling that federal law protects contractors from infringement suits arising from work they perform for the government.

The Federal Circuit held in an en banc decision that the trial court had inadvertently erred as a matter of law in authorizing the amendment and transfer to federal district court of Zoltek’s claim against Lockheed.
