9th Circ. Seeks Amicus Briefs On Medicare Claim Appeals

Law360, New York (March 14, 2012, 5:03 PM EDT) -- The Ninth Circuit on Wednesday asked for amicus parties to weigh in on questions of administrative review and jurisdiction in a suit questioning whether health care providers can appeal decisions not to reopen Medicare claims.

The appeals court asked for amicus briefs to address whether administrative review of a contractor’s decision to reopen a Medicare claim is barred and, if so, whether federal courts have jurisdiction to enforce the Department of Health and Human Services' compliance with the good cause standard for reopening in a suit....
