Samsung's Bid To Ban Apple Sales Denied In The Hague

Law360, New York (March 15, 2012, 1:39 PM EDT) -- A Dutch court on Wednesday denied Samsung Electronics Co. Ltd.'s bid to ban iPad and iPhone sales over alleged infringement of Samsung's 3G technology, ruling that Apple Inc.'s openness to licensing its rival's patents makes an injunction unwarranted.

The District Court of The Hague rejected Samsung's request for the sales ban, citing the fair, reasonable and nondiscriminatory licensing standard, or FRAND, which requires companies holding patents essential to a certain industry — like 3G technology is to the mobile device market — to attempt to license...
