9th Circ. Affirms Denial Of Class Cert. In Aerotek OT Case

Law360, New York (March 16, 2012, 9:11 PM EDT) -- The Ninth Circuit on Thursday affirmed a lower court's decision to deny class certification to more than 725 employees from staffing firm Aerotek Inc., rejecting their argument that the lower court misapplied precedents on whether workers' common issues predominate.

In a unanimous decision, a three-judge panel said a California federal court did not abuse its discretion when it denied recruiters class certification on the basis that the varying responsibilities of the workers took precedence over their common issues.
