Judge Denies United Tech's Dismissal Request

Law360, New York (August 10, 2007, 12:00 AM EDT) -- United Technologies Corp. received a blow Thursday in a proposed class action that alleges it poorly managed its employees' 401(k) plans, when a federal judge let stand all but one of the plaintiffs' breach of fiduciary duty claims.

Senior Judge Warren W. Eginton of the U.S. District Court for the District of Connecticut held that the defendants' failure to disclose information about two of their plans' management meant that there was no basis for dismissal of the plaintiffs' claims.
