Hospital Group Says FCA Suit Is Light On False Claims

Law360, Washington (March 26, 2012, 8:13 PM EDT) -- Hospital group Health Management Associates Inc. on Monday asked a Florida federal court to toss a former employee’s qui tam False Claims Act suit claiming HMA paid kickbacks to doctors, saying the plaintiffs haven’t identified any false Medicare or Medicaid claims.

The motion comes less than a month after the government and former HMA employee J. Michael Mastej filed a third amended complaint in the case, alleging HMA paid kickbacks to surgeons if they encouraged their patients to use facilities owned by the group.
