Law360, New York (March 29, 2012, 4:44 PM EDT) -- A senior claiming Bankers Life and Casualty Co. duped her into buying unsuitable deferred annuities can't represent a nationwide class in her lawsuit against the insurer, an Illinois federal judge ruled Thursday, saying the plaintiff's evidence on Bankers' nationwide practices was too weak.
U.S. District Judge Robert M. Dow Jr. said the lead plaintiff, California-resident Estella Rowe, had not provided enough evidence that Bankers has a policy of tricking seniors into buying the annuities throughout the U.S.
