Sleepy's Beats OT Suit By Independent Delivery Drivers

Law360, New York (March 29, 2012, 6:33 PM EDT) -- Sleepy's LLC on Thursday won dismissal of a proposed class action accusing the mattress retailer of violating wage laws after the New Jersey federal court ruled the company properly classified its delivery drivers as independent contractors.

U.S. District Judge Peter G. Sheridan granted a motion for summary judgment filed by Sleepy's, saying that the mattress seller had broken no labor laws by classifying its on-call drivers as exempt from overtime and other job benefits.
