Judge Decertifies Audit Class In Deloitte OT Case

Law360, New York (April 2, 2012, 9:05 PM EDT) -- A California federal judge last week decertified a class of unlicensed accountants and other audit employees who allege that Deloitte & Touche LLP failed to offer them proper overtime compensation, finding that the workers failed to demonstrate that common issues dominate the class.

U.S. District Judge Susan Illston on March 27 ruled that the “voluminous and conflicting evidence” in the class members' declarations and deposition testimony showed wide variation in the job duties and work experiences of the class members.
