San Juan Off The Hook In Pay Phone Antitrust Suit

Law360, New York (April 4, 2012, 8:54 PM EDT) -- A Puerto Rico federal judge on Wednesday dismissed Pan-American Telephone Co.'s antitrust class action alleging the city of San Juan conspired to award competitor Phoneworks Inc. a pay phone contract, ruling the company had failed to show its claims were not stale.

The municipality contended in an August motion to dismiss that the allegations, made under the Sherman and Clayton Acts, were time-barred. Pan-American had four years after the disputed bid occurred to bring claims under the federal laws, but since the bid process took place...
