2nd Circ. Says Health Provider Can't Sue On Patients' Behalf

Law360, New York (April 6, 2012, 7:44 PM EDT) -- Nonprofit mental health services provider Disability Advocates Inc. cannot sue several New York state mental health agencies over the living accommodations of patients, the Second Circuit ruled Friday, saying the state contractor did not have standing to represent patients in the suit.

The Second Circuit's ruling overturns a 2010 ruling from a New York federal court that required the state to transfer certain patients with mild mental illnesses away from patients with more severe disabilities and place them in less restrictive living environments.
