Ernst & Young Asks 2nd Circ. To Force Arbitration For Pay Row

Law360, New York (April 11, 2012, 6:12 PM EDT) -- Ernst & Young LLP urged the Second Circuit on Tuesday to send to arbitration a proposed class action alleging the company denied accountants overtime, contending an employment contract requires employees to individually arbitrate claims.

In a brief filed Tuesday, the accounting giant asked the appeals court to force lead plaintiff Stephanie Sutherland to arbitrate her overtime claims, arguing that arbitration was the proper venue for the case.
