Ecolab Can't Defeat OT Class Cert. With Hazmat Exemption

Law360, New York (April 12, 2012, 5:01 PM EDT) -- A California federal judge on Wednesday certified a class of hundreds of Ecolab Inc. pest control employees, striking down the sanitation giant's argument that the workers were exempt from overtime pay because they handled hazardous materials.

U.S. District Judge Gary A. Feess said the exterminators' claims that Ecolab violated state labor laws by cheating them out of overtime wages “easily” satisfied the requirements for class status.
