Citi OT Class Fights For Collective Action Rights In 2nd Circ.

Law360, New York (April 13, 2012, 7:36 PM EDT) -- A class of Citigroup Inc. employees on Friday told the Second Circuit that a statute that favors arbitration in overtime pay disputes does not justify a waiver of collective action rights under the Fair Labor Standards Act.

The class, led by Citigroup home lending specialists Tara Raniere, Nichol Bodden and Mark A. Vosburgh, who allege they were misclassified under FLSA and denied overtime, urged the appeals court to uphold an order blocking Citigroup's motion to compel arbitration because the company's arbitration policy would force the employees...
