Judge Melts Sugar In The Raw Advertising Suit

Law360, New York (April 17, 2012, 12:21 PM EDT) -- A federal judge on Monday tossed a proposed class action against Cumberland Packing Corp. and Sugar Foods Corp., saying the plaintiff couldn’t prove the companies used deceptive and misleading labeling for their Sugar in the Raw products.

Reasonable consumers could not be led to believe that Sugar in the Raw contains unprocessed and unrefined sugar, as plaintiff Talee Rooney had claimed, U.S. District Judge Marilyn L. Huff said in an order granting Cumberland’s and Sugar Foods’ motion to dismiss the case.
