Software Co. Targets New Century Attorneys

Law360, New York (August 27, 2007, 12:00 AM EDT) -- New Century Holdings Inc. has cried foul at Positive Software Solutions Inc.'s latest effort to kickstart its copyright claims, saying the suit the software company launched against the lender's ex-executives and law firm, Susman Godfrey LLP, constitutes another sanctionable violation of its bankruptcy's stay.

The suit has dragged on for four years and during that time has ballooned from a copyright infringement suit into a battle over an allegedly improper arbitration award. Complicated by the lender's bankruptcy, the suit's contentious tone has ratcheted up several notches...
