Pulte Avoids Revival Of NJ Development Battle

Law360, New York (May 3, 2012, 6:24 PM EDT) -- A New Jersey appeals court on Thursday refused to revive Larken Associates LLC's suit against developers including Pulte Homes of New Jersey LP over sewer access litigation that allegedly hurt a Larken commercial project, rejecting arguments that the earlier action was malicious.

In a related appeal, the court also backed summary judgment for Hill Wallack LLP, which Larken accused of abuse of process and legal malpractice based on its representation of Larken in securing a local approval for its Readington, N.J., project and the firm's later...
