9th Circ. Tosses Veterans' Claims Of Benefits Delays

Law360, New York (May 8, 2012, 4:34 PM EDT) -- The Ninth Circuit on Monday rejected civil rights claims from two nonprofit military groups that alleged their members face intolerable delays in receiving veterans benefits, saying Congress has largely barred federal courts from addressing such matters.

The 10-1 en banc opinion reversed a decision issued last year by a Ninth Circuit panel, which pointed to alarmingly high suicide rates among troops and concluded that the nation's veterans possess a “towering interest” in prompt mental health treatment.
