Calif. Court Won't Revive 7-Eleven Payroll Suit

Law360, New York (May 9, 2012, 1:43 PM EDT) -- A California appeals court on Tuesday upheld the dismissal of a class action claiming 7-Eleven Inc.'s method of calculating pay gave workers short shrift, holding that 7-Eleven wasn't the plaintiff's employer and faulting her complaint for failing to cite California's labor code.

Former 7-Eleven clerk Kimberly Aleksick claimed the company's payroll system violated the unfair competition law, which prohibits unlawful business practices.
