Lap-Band Marketer, Clinics Can't Push Patients Into Arbitration

Law360, New York (May 9, 2012, 9:55 PM EDT) -- A California judge on Wednesday refused to order a class of patients who were injured or died after undergoing Lap-Band procedures to arbitrate claims alleging a marketing firm and Los Angeles-based clinics failed to warn patients about the risks of the weight loss surgery.

Judge Kenneth Freeman denied a bid by Top Surgeons Inc., 1-800-Get-Thin LLC and other related medical clinics that performed the procedure to bind named plaintiffs to arbitration. Among the plaintiffs named in the lawsuit are Laura Lee Faitro and Ana Renteria, who...
