Schering, Employees To Face Off Over Benefit Plan

Law360, New York (September 5, 2007, 12:00 AM EDT) -- Drug company Schering-Plough Corp. and a purported class of employees are gearing up to resume an ERISA suit originally filed in 2003, dismissed and remanded on appeal, following a minor clash on Monday over procedure.

The named plaintiff in the case, Michele Wendel, filed her second motion for class certification last week. The court had denied Schering's motion to dismiss a part of Wendel's complaint on Aug. 15.
