Bloomberg's Fair Use Defense Beats Swatch Analyst Call Suit

Law360, New York (May 18, 2012, 5:21 PM EDT) -- Bloomberg LP didn't commit copyright infringement when it distributed a recording and transcript of a conference call between Swatch Group Ltd. executives and analysts, a New York federal judge ruled Thursday, holding that the publication of the recording was “fair use.”

U.S. District Judge Alvin K. Hellerstein granted Bloomberg summary judgment and said that The Swatch Group Management Services Ltd.'s second amended complaint, which leveled a single count for copyright infringement, should be dismissed.
