Retirees Win Again In 9th Circ. Raytheon Benefit Battle

Law360, New York (May 21, 2012, 6:16 PM EDT) -- The Ninth Circuit on Monday reaffirmed its 2010 ruling that defense contractor Raytheon Co. must repay millions of dollars in health care insurance premiums it charged a class of workers who took early retirement.

The appeals court, which had agreed to rehear the case in January 2011, once again concluded in a published opinion that the company's agreement to keep paying premiums until retirees and their spouses turned age 65 survived the expiration of collective bargaining agreements and could not be terminated, while continuing to side...
