5th Circ. Reopens Suit Over Texas Beachfront Land Seizure

Law360, New York (May 22, 2012, 6:46 PM EDT) -- The Fifth Circuit on Monday gave a former Texas landowner another shot at her claim that the state was wrong to seize her private waterfront land under the Texas Open Beaches Act.

The 5th Circuit said that, despite having since sold the beachfront property, California-based attorney Carol Severance has a right to continue her claim that the act violated the Fourth Amendment when the city used it to move public beach boundaries into the land area of one of her three rental properties on Galveston Island....
