3rd Circ. OKs Wal-Mart’s Appeal Of Cert. For Warranty Class

Law360, New York (May 23, 2012, 5:04 PM EDT) -- The Third Circuit gave Wal-Mart Stores Inc. a green light Wednesday to challenge the certification of a class of consumers who were allegedly sold worthless extended warranties for ineligible “as-is” merchandise, despite the plaintiff's insistence that the lower court's analysis was sound.

A three-judge appeals panel granted Wal-Mart's petition to appeal a March 12 class certification ruling in William Hayes' New Jersey Consumer Fraud Act, breach of contract and unjust enrichment suit.
