Judge Tosses Investor Suit Over $3B Atheros-Qualcomm Merger

Law360, New York (May 30, 2012, 3:16 PM EDT) -- A California federal judge on Tuesday agreed to nix a class action against Qualcomm Inc. and Atheros Communications Inc., ruling that investors hadn't proved there was any real loss from information not disclosed to shareholders when the telecommunications companies merged in 2011.

U.S. District Judge Lucy Koh sided with Qualcomm and Atheros, dismissing the complaint on grounds that investors failed to make a defensible claim in alleging shareholders' rights were violated by the omission. The companies made a motion seeking dismissal at the beginning of March....
