DOE Given 6 Months To Justify $750M Nuclear Waste Fees

Law360, New York (June 1, 2012, 5:06 PM EDT) -- The D.C. Circuit on Friday gave the U.S. Energy Department six months to justify the $750 million it still collects each year from nuclear power companies despite shelving plans for the Yucca Mountain waste disposal site, whose cost was the basis for the fee.

The three-judge panel at the appeals court found the department's 2010 fee determination was "legally defective" and gave Secretary Stephen Chu until December to determine whether the money collected matches the actual cost of handling radioactive waste.
