CVS Caremark Can't Escape FCA Suit Over Insurance Fraud

Law360, New York (June 5, 2012, 7:25 PM EDT) -- A Texas federal judge on Tuesday refused to toss a long-running employee whistleblower suit claiming a CVS Caremark Corp. unit defrauded government insurance programs by not reimbursing expenses that should have been covered by private insurers.

After a hearing on Tuesday, U.S. District Judge W. Royal Furgeson Jr. issued a short order denying Caremark's bids to dismiss the False Claims Act suit brought by Janaki Ramadoss, a former Caremark quality assurance representative.

The judge denied the motions without prejudice but did not give any reason behind...
