NJ Developer Must Hand Units To City For $1 Each, Court Says

Law360, New York (June 6, 2012, 6:53 PM EDT) -- A New Jersey appeals court on Wednesday ruled that developer Washington Commons LLC must give Jersey City title to seven affordable housing units at the center of a protracted legal battle, saying the developer hadn't shown that denial of discovery prejudiced its case.

The appeals panel found that a lower court hadn't erred last fall when it denied Washington Common's request for discovery and granted Jersey City ownership of the units the developer had agreed to sell to the city for $1 each in 2004 deal....
