5th Circ. Upholds EPA's Rejection Of Texas Clean Air Plan

Law360, New York (June 15, 2012, 7:30 PM EDT) -- The Fifth Circuit on Friday upheld the U.S. Environmental Protection Agency's rejection of revisions to Texas' state implementation plan for the Clean Air Act, which would affect utilities, ruling that the agency had not abused its discretion when it disapproved the program for not meeting federal requirements.
