Federal Law Trumps Truckers' Break Claims Post-Brinker: Judge

Law360, New York (June 18, 2012, 6:11 PM EDT) -- A California federal judge wrapped up a putative class action Thursday against delivery truck company Vitran Express Inc., marking the first ruling in which the Federal Aviation Administration Authorization Act trumped meal break claims since the California Supreme Court's landmark Brinker decision.

U.S. District Judge Gary Klausner's judgment nixed former Vitran drivers Brandon Campbell and Ralph Maldonado's lawsuit, originally filed in state court in 2010, and granted Vitran's motion for judgment on the pleadings.
