Former Distributors Lose Appeal Against Hearst

Law360 (September 18, 2007, 12:00 AM EDT) -- Six former distributors of the Houston Chronicle have lost their wrongful termination and antitrust suit after an appeals court affirmed a ruling in favor of Hearst Corp., which owns the daily newspaper.

On Tuesday, the U.S. Court of Appeals for the Fifth Circuit affirmed that a federal court was correct in dismissing the distributors’ antitrust claims for lack of standing, and dismissed their wrongful termination and breach of contract claims due to a previous state court judgment on the same claims.
