Texas High Court Reinstates Easement Case Over Dallas Line

Law360, New York (June 22, 2012, 5:40 PM EDT) -- The Texas Supreme Court on Friday revived a Texas utility's suit against two regional public transportation authorities over an easement on their land to build a transmission line serving Dallas County, finding that a new state rule does not automatically grant governmental immunity in such cases.

The Supreme Court sided with Oncor Electric Delivery Co. LLC, which said that a decision by a lower court tossing the case should be reconsidered in light of a new rule passed by the Texas State Senate in May 2011....
