Supreme Court Remands Tribal Group-HHS Contract Row

Law360, New York (June 25, 2012, 7:25 PM EDT) -- The U.S. Supreme Court on Monday sent back to the Federal Circuit a ruling that the Arctic Slope Native Association couldn't recover unpaid costs on U.S. Department of Health and Human Services contracts, after a similar high court decision that the government must honor contractual promises.

The ASNA's contract battle with HHS closely mirrored a similar contract payment fight between Indian tribes and the U.S. Department of the Interior in Salazar v. Ramah Navajo. But the Federal Circuit and the Tenth Circuit came to opposite conclusions...
