Supreme Court Won't Touch $926M Dow Contamination Suit

Law360, New York (June 25, 2012, 1:36 PM EDT) -- The U.S. Supreme Court refused Monday to hear a challenge to the reversal of a $926 million class action judgment against Dow Chemical Co. over plutonium contamination, handing a victory to the nation’s solicitor general, who had filed a brief supporting the company.

The court denied the May 2011 petition for certiorari by a proposed class of more than 15,000 property owners. The plaintiffs lost an appeal in the Tenth Circuit seeking to revive the judgment against Dow and Rockwell International Corp., which allegedly released plutonium...
