Bankruptcy Trust Suffers Blow In Microsoft Suit

Law360 (September 19, 2007, 12:00 AM EDT) -- A federal appeals court has found that creditors for a bankrupt Internet service provider lacked the legal standing to file a patent infringement suit against Microsoft Corp. over hypertext technology.

The U.S. Court of Appeals for the Federal Circuit determined Wednesday that a liquidating trust established to pay unsecured creditors of At Home Corp., which filed for bankruptcy protection in 2001, did not have authority to pursue infringement claims regarding a patent the company obtained to pay off its debt.
