Samsung Must Pay $38M For Willful Infringement In Fractus Suit

Law360, New York (June 29, 2012, 12:00 AM EDT) -- A federal judge in Texas on Thursday stung Samsung Electronics Co. with an additional $15 million for willful infringement of four Fractus SA patents covering cell phone antenna technology, adding to a $23 million penalty already levied by a jury.

U.S. District Judge Leonard Davis said he could have levied enhanced damages of up to three times the jury verdict, or $69 million, but determined that Samsung's conduct, although bad, wasn't malicious.
