XL Must Yield Docs In Workers' Comp Row: Texas High Court

Law360, New York (June 29, 2012, 6:13 PM EDT) -- The Texas Supreme Court ruled Friday that attorney-client privilege does not protect communications between XL Specialty Insurance Co.'s lawyer and Cintas Corp. made during a worker's compensation proceeding and may not be withheld from the worker, who is now suing the insurer.

Although XL is Cintas' workers' compensation insurer, the court ruled that because they were not joint clients of XL's outside counsel and because their interests were only aligned in the administrative proceeding — and not the worker's pending lawsuit against the insurer alone —...
