Shaw Gets Inspectors' Salary Claims Slashed From OT Suit

Law360, New York (July 2, 2012, 3:37 PM EDT) -- A New Jersey federal judge dealt a blow to a putative class and collective action against Shaw Environmental Inc. on Friday, rejecting claims that Shaw construction inspectors were paid hourly, not salaried, and thus entitled to premium overtime pay.

U.S. District Judge Esther Salas partially granted Shaw's motion for judgment on the pleadings, ruling the plaintiffs were salaried, exempt employees under the Fair Labor Standards Act's salary basis test.
